1. Welcome to Tempteo

Welcome to Tempteo ("we," "us," or "our"). Tempteo provides an AI character platform that includes AI-powered chat, image generation, voice interactions, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms").

If you do not agree with these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Registration

You must be at least 18 to use the Service. Our companions are AI characters, not real people. Their messages, photos, and voices are AI-generated.

These Terms also apply to our Telegram bots. When you start a bot, we use your Telegram account to create or find your Tempteo account. Before chatting, the bot asks you to confirm that you are 18 or older and accept these Terms.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access to your account.

3. Subscriptions & Credits

Tempteo offers a free tier, Premium subscriptions, and one-time credit packs. Online purchases are completed through secure Stripe-hosted checkout.

Clara's prepared welcome photo and voice note are free and do not spend your credits. Further photos and voice notes use credits; videos require Plus. The bot and app show the available options and your balance.

• Free Tier: Limited image generations per month. Premium subscribers receive expanded image generation access and additional features.
• Premium Subscription: Available in weekly, monthly, and yearly billing cycles. It includes a monthly credit allocation for eligible creative tools and other Premium features.
• Credit Packs: One-time purchases of additional credits. Credits do not expire. They are Tempteo-only service units, are non-transferable, cannot be redeemed for cash, and are not accepted by third parties.

All prices are in USD and are subject to change. Paid subscriptions automatically renew for the selected billing cycle unless cancelled before the end of the current billing period. The exact amount and renewal period are shown before checkout. Premium access and one-time credits are added after payment confirmation. The card-statement descriptor is listed with our billing support details below so you can recognize the charge.

4. User Conduct

The Service is for adults. Consensual sexual chat and generated media involving clearly adult fictional characters are permitted, subject to feature availability and these rules.

You agree not to use the Service to:

• Generate, share, or distribute child sexual abuse material (CSAM). We maintain a zero-tolerance policy and will report violations to relevant authorities.
• Create, request, share, or distribute sexual content involving a minor or an age-ambiguous person, non-consensual sexual acts, sexual violence, or real incest.
• Create content that depicts real, identifiable individuals without their consent.
• Harass, threaten, or abuse other users or any third party.
• Upload or transmit malware, viruses, or other harmful code.
• Attempt to gain unauthorized access to any part of the Service.
• Use automated tools (bots, scrapers) to access the Service without written permission.
• Violate any applicable law or regulation.

We reserve the right to suspend or terminate accounts that violate these rules, without refund or notice.

5. Intellectual Property

All AI-generated content produced through the Service (including images, text, and voice outputs) is owned by Tempteo. We grant you a limited, non-exclusive, non-transferable license to use AI-generated content for personal, non-commercial purposes.

You may not sell, license, or distribute AI-generated content from Tempteo without our prior written consent. The Tempteo name, logo, and all related trademarks are the property of Tempteo.

6. Termination

You may delete your account at any time through the account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in prohibited conduct, or for any reason we deem necessary to protect the Service or other users.

7. DMCA & Copyright

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a DMCA takedown notice to support@tempteo.com with the following information:

• Identification of the copyrighted work claimed to have been infringed.
• Identification of the infringing material and its location on the Service.
• Your contact information (name, address, email, phone).
• A statement of good faith belief that the use is not authorized.
• A statement under penalty of perjury that the information is accurate.
• Your physical or electronic signature.

8. Disclaimer & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

To the maximum extent permitted by law, Tempteo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to Tempteo in the 12 months preceding the claim.

9. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against Tempteo.
